Allowing Break Waivers and Enforcing Break Guardrails

Purpose

Two optional layers sit on top of a break rule. Waivers let employees formally decline an eligible break under conditions you control. Guardrails enforce compliant behaviour in real time: they stop early breaks, block early break-ends, auto-end breaks, and flag short or long ones. Both are configured on the break rule itself.

When to use this: add a waiver when your state allows employees to skip a meal break on shorter shifts with written consent, and you want that choice recorded on the entry instead of paying a premium. Add guardrails when missed, short, or long breaks are a recurring problem and reminders alone have not fixed it.

Who can do this: users with permission to manage Time Tracking settings (typically the Employer Admin).

Break waiver

A waiver lets an employee decline a break through the attestation pop-up at clock-out. A waived break is recorded on the time entry instead of being flagged as missed.

Availability. The Break Waiver section appears only when all three are true on the rule:

  1. Eligibility is set By Custom Time Interval.
  2. The missed-break action is Flag Missing Break (not Deduct).
  3. Break attestation required? is checked.

Attestation itself is only available in Flag mode, which is why the chain runs through it. See Break Rules Setup.

Configure the waiver per eligible break (Break 1, Break 2, and so on):

With no duration limits set, the waiver is offered without a shift-length restriction.

Warning: UZIO records the waiver on the time entry. Any written mutual-consent agreement your state requires for break waivers must be managed outside time tracking.

Guardrails

Enable any combination per break rule:

Note: The short-break and long-break variance values cannot exceed the break's own duration. The form blocks a larger value.

Expected outcome

  • Employees on a waiver-enabled break see a waiver option on the break attestation pop-up at clock-out when the waiver's conditions are met. A waived break is recorded on the entry instead of being flagged as missed, and no missed-break premium applies to it.
  • Guardrails act in real time while the employee is punched in. Early starts and early ends are blocked, auto-end closes the break on schedule, and Short and Long flags appear on the entry for review. Short and Long flags do not block approval of the employee's hours.

Common problems

Why is the meal or rest break premium showing the wrong hours?

Premiums apply on two conditions, a missed break or a short break, and are capped at 1 hour per break category (meal or rest) per time entry. Two missed meal breaks with a 1-hour premium each still pay 1 hour. Check that the premium is configured on the rule, then look at the entry for missed and short breaks. Where can I see my configured break rules?

Time Tracking Settings > Break Rules. Click a break name to view its configuration and the employees it is assigned to.

The Break Waiver section is not on my rule

One of the three availability conditions is not met. Check that eligibility is By Custom Time Interval, the missed-break action is Flag Missing Break, and Break attestation required? is checked. Note that eligibility mode is locked once the rule has time entries; if the rule is on Recurring, create a new rule.

Tip: Prevent Early Break End and Automatically end break solve opposite problems. The first stops employees cutting a break short, which triggers a premium in some states. The second stops breaks running long. California-style setups often enable both.
